Terms of Service

These Terms govern your use of the Truck Me mobile application and website. Read them carefully, they contain important disclaimers about the nature of routing data and your responsibility as a driver or operator.

1. Agreement to These Terms

By downloading, installing, or using the Truck Me mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Truck Me Pty Ltd ("we," "us," "our," "Truck Me") reserves the right to modify these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. User Eligibility

To use Truck Me you must:

  • Be 18 years of age or older.
  • Be a licensed heavy vehicle driver, fleet operator, or transport manager operating under the Heavy Vehicle National Law (HVNL).
  • Hold all licences, permits, and vehicle accreditations required for your vehicle type and intended routes. Truck Me does not verify this.
  • Not be prohibited from using the Service under any applicable Australian law or regulation.

3. Route Data, NHVR Source & Accuracy Disclaimer

Truck Me sources route and road network data directly from the National Heavy Vehicle Regulator (NHVR) API. We display this data as-is and do not independently verify, audit, or modify it.

Truck Me makes no warranty, express or implied, as to the accuracy, completeness, currency, or fitness for purpose of NHVR data. In particular:

  • Road network access rules change frequently. Approvals, conditions, and restrictions may be updated by NHVR, road managers, or state governments without notice to Truck Me.
  • Data displayed in the app may lag behind changes in the actual NHVR network due to caching or API update cycles.
  • Routes shown as approved for a vehicle class may not reflect short-term or emergency access restrictions in place at the time of travel.

For any route where compliance is critical, you must verify current access conditions directly with the NHVR (nhvr.gov.au) or the relevant road manager before travel.

4. No Liability for Compliance, Driver & Operator Responsibility

Truck Me is a routing assistance tool only. It is not a compliance advisory service, a permit system, or a substitute for professional transport management advice.

The driver and operator remain solely and exclusively responsible for:

  • Compliance with all obligations under the Heavy Vehicle National Law (HVNL) and any applicable state or territory legislation.
  • Ensuring the vehicle, load, and combination type are approved for each road segment used.
  • Observing all conditions of access, including weight limits, bridge clearances, time-of-travel restrictions, and escort requirements.
  • Holding and complying with any mass or dimension permits required for the journey.
  • Exercising independent professional judgment before, during, and after each journey.

Truck Me accepts no liability for any fines, infringement notices, penalties, impoundments, accidents, injuries, property damage, death, or any other loss of any kind arising directly or indirectly from reliance on route data, map overlays, or any other information provided by the Service.

5. No Warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • ANY WARRANTY THAT ROUTE DATA IS ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR HEAVY VEHICLE OPERATIONS.
  • ANY WARRANTY THAT COMMUNITY INCIDENT REPORTS ARE ACCURATE OR THAT ACTING ON THEM WILL ENSURE SAFE OR LEGAL TRAVEL.

Some jurisdictions do not allow exclusion of implied warranties. To the extent such warranties cannot be excluded, they are limited to the minimum scope and duration permitted by law.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • No consequential damages: WE ARE NOT LIABLE FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • Liability cap: OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO TRUCKSHEET IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE PAID NOTHING, OUR LIABILITY IS CAPPED AT AUD $50.
  • Accidents and injuries: WE ARE NOT LIABLE FOR ACCIDENTS, PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH RESULTING FROM YOUR USE OF THE SERVICE, YOUR DRIVING, OR YOUR RELIANCE ON ROUTE DATA, WARNINGS, SPEED ALERTS, OR COMMUNITY REPORTS.
  • Fines and penalties: WE ARE NOT LIABLE FOR ANY FINES, INFRINGEMENT NOTICES, DEMERIT POINTS, VEHICLE IMPOUNDMENT, LICENCE SUSPENSION, OR OTHER REGULATORY CONSEQUENCES RESULTING FROM YOUR USE OF A ROUTE PROVIDED BY THE SERVICE.

7. Driver and Operator Responsibility

You represent and warrant that you:

  • Hold a valid heavy vehicle licence appropriate for the vehicle class you are operating.
  • Hold all required permits, accreditations, and exemptions for your vehicle combination and intended route.
  • Understand that Truck Me does not verify your licence, permit status, or vehicle configuration.
  • Will not operate a vehicle on a route that you know or suspect requires access conditions you do not meet, regardless of what the app displays.
  • Are solely responsible for the roadworthiness of your vehicle, the safety of your load, and the compliance of your combination with applicable mass and dimension standards.
  • Understand that bridge clearance warnings and speed alerts are informational aids only and must not be relied upon as the sole means of hazard detection.

8. Fleet Accounts & Data Sharing

Fleet administrators who create a fleet organisation on Truck Me and invite drivers consent to the following:

  • Invited drivers' trip logs, vehicle profiles, and (where enabled) location data may be visible to fleet administrators within the Truck Me fleet dashboard.
  • Fleet administrators must obtain appropriate consent from drivers before enabling location tracking or accessing driver logbook data. This obligation rests entirely with the fleet administrator.
  • Drivers may leave a fleet at any time via Settings. Upon leaving, real-time location sharing ceases immediately. Historical fleet data is subject to the fleet administrator's data retention settings.
  • Truck Me does not verify that fleet administrators have obtained the consent required by applicable privacy legislation, including the Privacy Act 1988 (Cth).

9. Accounts & Passwords

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are liable for all activities that occur under your account.
  • You must notify us immediately at legal@truckme.au of any unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

10. Community Reports & Incidents

Incident reports are crowd-sourced and unverified. You agree that:

  • Reports you submit are accurate to the best of your knowledge.
  • You will not submit false, defamatory, or misleading reports.
  • You will not rely on community reports as your sole source of road condition information. They are supplementary intelligence only.

We have no obligation to moderate reports. We are not liable for any harm resulting from reliance on community-submitted data.

11. Subscription & Billing

  • Subscriptions are billed monthly or annually via Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis.
  • Pricing may change with 30 days' notice. Changes do not affect active subscription periods already paid.
  • No refunds are given for partial billing periods. Cancellation takes effect at end of the current period.
  • For billing disputes, contact us within 30 days of the charge at legal@truckme.au.

12. NHVR & Third-Party Services

  • Route and network data are sourced from the NHVR API and are not created or controlled by Truck Me.
  • Map tiles and directions data are provided by Mapbox under their own terms and privacy policy.
  • Payments are processed by Stripe. Push notifications are delivered via Firebase Cloud Messaging (Google).
  • We are not responsible for errors, outages, or changes in any third-party service.

13. Intellectual Property

All content, code, design, and data in the Service (excluding NHVR data and user-submitted content) are owned by or licensed to Truck Me. You receive a limited, non-exclusive, non-transferable licence to use the Service for lawful heavy vehicle routing purposes. You must not copy, reverse-engineer, decompile, scrape, or resell any part of the Service.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent or illegal activity, non-payment, or discontinuation of the Service. On termination, your licence to use the Service ceases immediately. Clauses 4, 5, 6, 7, and 15 survive termination.

15. Indemnification

You agree to indemnify and hold harmless Truck Me, its officers, employees, and agents from any claims, damages, losses, fines, or expenses (including legal fees) arising from: your use of the Service; your driving or vehicle operation; your breach of these Terms; your violation of any law, regulation, or road access condition; or your submission of false incident reports.

16. Governing Law

These Terms are governed by the laws of the State of Queensland, Australia, without regard to conflict-of-law rules. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland.

17. Dispute Resolution

Before commencing legal proceedings, both parties agree to attempt resolution in good faith through written negotiation. If unresolved after 30 days, either party may pursue legal action in the courts of Queensland.

18. Severability

If any provision of these Terms is found invalid or unenforceable, that provision is severed and the remaining provisions continue in full force and effect.
